Thanks for the response,

Tried the CYGWIN options and the 
updated cygwin1.dll and the problem did 
not change.  It is interesting that the 
number of files required to make it 
fail is not absolute - may vary btwn 
38..45.

Here are the results of cygcheck -s -v:
